Rules and conditions you must comply with when using the WiaMenu service. Please read carefully.

1. Service Description and Acceptance

  • •WiaMenu is a SaaS (Software as a Service) platform that provides a digital menu management system for restaurants and cafes.
  • •By using this service, you agree to these terms of use.
  • •If you are under 18 or do not have the legal capacity to enter into a contract, you must obtain your parent or guardian's consent before using this service.
  • •If you do not accept these terms, please do not use the service.

2. User Account and Security

  • •To use the service, you must create a user account.
  • •The information you provide during registration must be accurate, current and complete.
  • •You are responsible for account security. Do not share your password with others.
  • •If you notice any unauthorized use of your account, you must notify us immediately.
  • •A person or organization can only create one account (multiple accounts are prohibited).

3. Terms of Use and Prohibitions

  • •You must use the Service for lawful purposes only.
  • •You may not use the Platform to share spam, malware or illegal content.
  • •You may not violate the rights of, harass or harass other users.
  • •You may not attempt to gain unauthorized access to the system (hacking, reverse engineering).
  • •You may not infringe intellectual property rights by using the Service.
  • •You may not abuse the service with bots or automated tools.

4. Intellectual Property Rights

  • •The platform, its content, design, logos and all intellectual property rights belong to WiaMenu.
  • •The content you upload (menu items, photos, etc.) belongs to you.
  • •By using the Platform, you license us to use your content to provide the service.
  • •We will not use your content for any other purposes or share it with third parties.

5. Service Interruptions and Disclaimers

  • •We strive to provide uninterrupted service, but we do not guarantee 100% uptime.
  • •Advance notice will be given for planned maintenance and updates.
  • •Service interruptions may occur due to unexpected technical problems, natural disasters or DDoS attacks.
  • •We are not responsible for any losses that may occur due to service interruptions.
  • •We provide the service 'as is' without any warranty.

6. Account Cancellation and Suspension

  • •You can cancel your account at any time (settings > account > close account).
  • •If you violate these terms of use, we may suspend or close your account.
  • •When the account is closed, all your data will be deleted within 30 days.
  • •Unpaid accounts are automatically suspended after 30 days.
  • •If service abuse is detected, the account may be closed immediately and no refund will be given.

7. Pricing and Refunds

  • •Service fees are stated on the pricing page.
  • •Payments can be automatically renewed monthly or annually.
  • •You will be notified by email before automatic renewal.
  • •Discounts apply for annual subscriptions.
  • •Please review the 'Delivery and Return Conditions' page for our return policy.
  • •Price changes are notified to existing subscribers 30 days in advance.

8. Privacy and Data Protection

  • •Your personal data is processed in accordance with our Privacy Policy.
  • •We fully comply with KVKK and GDPR regulations.
  • •We do not share your data with third parties (except for legal obligations).
  • •All data is stored encrypted.
  • •We use industry standards for data security.

9. Limitation of Liability

  • •We are not liable for any indirect, incidental or consequential damages arising from the use of the service.
  • •Our total liability is limited to the total service fees you have paid in the last 12 months.
  • •We are not responsible for any issues caused by third-party integrations.
  • •We are not responsible for any legal issues arising from user content.
  • •We cannot be held responsible in cases of force majeure.

10. Changes and Updates

  • •We reserve the right to change these terms of use at any time.
  • •You will be notified by email for important changes.
  • •Changes come into force 7 days after they are published.
  • •If you do not accept the changes, you can close your account.
  • •By continuing to use the service you are deemed to have accepted the changes.

11. Applicable Law and Competent Court

  • •This agreement is subject to the laws of the Republic of Türkiye.
  • •Istanbul (Çağlayan) Courts and Enforcement Offices are authorized to resolve disputes.
  • •Consumer Arbitration Committees and Consumer Courts are authorized in consumer transactions.
  • •Disputes will first be tried to be resolved within the framework of good faith.

Declaration of Acceptance

By using the WiaMenu service, you declare that you have read, understood and accepted all the above terms of use. If you do not comply with these terms, your account may be suspended or closed. Please contact us for your questions.
